Acordo de Termos de Serviço, Privacidade e Aviso de Risco

1. Introdução e Natureza dos Serviços (SaaS)

A Forex Sinais Premium ("Nós", "Plataforma" ou "Empresa") é uma provedora de tecnologia e infraestrutura de software como serviço (SaaS). Nós fornecemos este site, aplicativo móvel, extensão de navegador, Bot do Telegram e Telegram Mini App (coletivamente, os "Serviços").

NÃO SOMOS UMA CORRETORA, GESTORA DE RECURSOS OU EMPRESA DE ANÁLISE DE VALORES MOBILIÁRIOS. Nossos Serviços consistem em fornecer uma plataforma de automação, roteamento operacional, parametrização de risco e espelhamento de dados (Copytrade) baseada em infraestrutura em nuvem de baixa latência (utilizando tecnologia MetaApi).

O cliente mantém sua própria conta, custódia e capital na corretora parceira oficial (FxPro). A Forex Sinais Premium apenas fornece a interface tecnológica (via API) para que o cliente, por sua própria conta e risco, automatize a execução de estratégias. Ao utilizar nossos Serviços, você reconhece e concorda expressamente com este Acordo e com a nossa Política de Privacidade.

2. Aviso de Risco de Mercado e Automação

2.1. Risco Integral do Cliente: A negociação em mercados financeiros (Forex, XAUUSD, CFDs) envolve risco substancial de perda e não é adequada para todos os investidores. O valor dos investimentos pode flutuar, e você pode perder todo o seu capital. Você é o único responsável por suas decisões de investimento e pela parametrização de risco configurada em nosso painel.

2.2. Isenção de Rentabilidade: A Forex Sinais Premium não faz nenhuma representação, promessa ou garantia de que as estratégias de negociação serão lucrativas. Desempenho passado (histórico estatístico) exibido na plataforma não é indicativo de resultados futuros. A Plataforma atua como um hub informacional e de execução; não fornecemos aconselhamento financeiro personalizado.

2.3. Riscos Tecnológicos e de Automação: Ao ativar a automação via Telegram Bot, Mini App ou Painel Web, você autoriza nossos servidores a enviarem sinais de negociação para sua conta na corretora parceira via API. Você reconhece os riscos inerentes à tecnologia, incluindo, mas não se limitando a: desconexões de API, latência de rede, slippage (deslizamento de preços), falhas de servidor de terceiros (Equinix, MetaApi, Telegram) ou instabilidades na corretora. A Forex Sinais Premium não será responsabilizada por perdas financeiras decorrentes de falhas técnicas.

3. Termos de Uso do Software

3.1. Licença e Elegibilidade: Concedemos a você uma licença limitada, revogável, não transferível e não exclusiva para acessar o SaaS. Você deve ter mais de 18 anos e capacidade legal para operar. O uso de robôs, scrapers ou engenharia reversa em nossa plataforma, extensão ou bots do Telegram é estritamente proibido.

3.2. Assinaturas e Pagamentos: O acesso aos recursos avançados (automação, painel analítico) exige uma assinatura. Os pagamentos são processados via provedores terceirizados seguros (ex: Stripe). O cliente autoriza cobranças recorrentes conforme o plano escolhido. As taxas referem-se estritamente ao licenciamento da tecnologia, e não a taxas de performance ou gestão de capital.

3.3. Integração com Corretora: O funcionamento pleno do sistema exige a vinculação de uma conta ativa na corretora FxPro, isentando a Forex Sinais Premium de qualquer responsabilidade sobre os fundos depositados, saques, compliance (KYC/AML) ou execução final das ordens, que são de responsabilidade exclusiva da corretora.

4. Política de Privacidade (Conformidade com a LGPD)

A Forex Sinais Premium atua como Controladora e Operadora de dados para fornecer os Serviços, em conformidade com a Lei Geral de Proteção de Dados (LGPD - Lei nº 13.709/2018).

4.1. Dados que Coletamos:

• Dados Cadastrais: Nome, e-mail, ID do Telegram (quando usar nossos bots/Mini Apps) e credenciais de acesso.
• Dados Operacionais: Logs de configuração de risco, histórico de conectividade, status de ativação/pausa de automação e dados de performance da sua conta apenas para fins de exibição no seu painel.
• Dados de Dispositivo: Endereço IP, cookies de sessão e informações do navegador/dispositivo para segurança (Zero Trust).

Nota: Não armazenamos o seu capital, senhas bancárias ou dados completos de cartão de crédito (processados via Stripe). Suas credenciais de negociação (MT4/MT5) são criptografadas (AES-256) e fragmentadas.

4.2. Compartilhamento de Dados:
Seus dados podem ser compartilhados exclusivamente com:

• FxPro (Corretora Parceira): Para fins de vinculação de conta, roteamento de ordens institucionais e compliance.
• MetaApi / Cloud Providers: Para garantir a latência sub-milissegundo na execução das ordens.
• Autoridades Legais: Somente se exigido por obrigação regulatória.

4.3. Seus Direitos: Você pode, a qualquer momento, revogar seu consentimento, pausar a automação, desconectar sua conta da corretora do nosso sistema ou solicitar a exclusão da sua conta e dados (direito ao esquecimento) através do painel de usuário ou contatando o suporte.

5. Limitação de Responsabilidade e Foro

Na extensão máxima permitida por lei, a Forex Sinais Premium e seus diretores, afiliados ou fornecedores de tecnologia não serão responsáveis por danos indiretos, incidentais, punitivos ou perdas financeiras resultantes do uso do software. Qualquer disputa relacionada a este Acordo será resolvida no foro da sede da Empresa, renunciando-se a qualquer outro.

If you use any part of our Site in violation of these terms, we may take the necessary actions to protect our rights.

“FXPRO” and associated trademarks are registered locally and internationally. You are not permitted to use these trademarks without our prior written approval.

We also hold exclusive rights to our domain name. You may not create or use any domain name that includes the word ‘fxpro’ alone or in combination with other words, unless explicitly authorized by us. Additionally, all content on our Site is copyrighted, and no part of it may be reproduced, adapted, linked, or distributed without our prior written consent.
